Boswarthen Farm – terms & conditions 1. Bookings Boswarthen Farm only handles bookings from persons over 18 years of age. We reserve the right, at all times, without statement of reasons, to refuse a booking. Once a deposit has been received you will be notified within 24 hours via an e-mail confirming details of your stay and of payments made and due. The confirmation and invoice must be checked immediately on receipt for any errors. Possible or claimed inadequacies must always be notified by e-mail or phone within 10 days following the date of the confirmation/invoice and in any case before the start of the stay. If, you have not received your booking confirmation within 24 hours you most notify us as soon as possible. When you submit a booking online via our reservation system you will receive an automatically generated booking summary to the e-mail address provided by you in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by post or e-mail. 2. Payments All bookings are subject to a 30% non-refundable booking deposit. An invoice for the full rental charge less the deposit already paid will be issued and the balance is payable 10 weeks before arrival. If you are unable to pay the balance before the stated due date, you will forfeit your deposit and your booking will be cancelled .VAT is chargeable at the applicable rate and is included in all charges. Please note that cheques should be made payable to Boswarthen Farm and sent to Mrs. M Nicholls, Boswarthen Farm Cottage, Newbridge, Penzance, Cornwall TR20 8PA, and must be received by us more than 10 weeks before the start date of your holiday. In the event of bookings made within 10 weeks before the start of your stay the entire booking amount must be paid immediately. Payments can only be made by debit cards, cheque and credit cards. A 2% surcharge will be applied to credit cards. We are unable to accept American Express or cash. 3. Prices The prices on the website are not binding; Boswarthen Farm reserves the right to modify these prices. At the time of booking you will be informed of the prices applicable. The price stated on the confirmation/invoice is binding. 4. Rental of the accommodation In the rental price of every tent or gypsy caravan the following is included: • Rental of accommodation and the pitch. • Bed linen. • Use of and access to the car park which adjoins the camping field. • Use of water. • Use of wood for the stove (a daily allocation per stay is provided but wood for campfires is not included) • VAT according to the guidelines of the VAT administration. Not included are, among other things: • Washing of the dishes. • Stripping of bed linen. • Putting rubbish into a waste bag and placing it in a container. 5. Arrival and departure Check-in is between 4pm and 6pm. We appreciate that your journey may not take as long as anticipated or may take longer due to circumstances beyond your control. In any event if you are unable to arrive between these times you must phone us and make us aware. If you arrive early we will do our best to allow you in but unfortunately we cannot guarantee that this will be the case. We do advise that you arrive before 6pm as the field and car park are not lit and it will take time to light the fire, make beds and unpack; this is extremely difficult in the dark. Departure is by 10am on the morning of your departure date. You should remove all rubbish to the refuse bin, have washed and dried the dishes and swept out the tent. Check-in is between 4pm and 6pm. Pets We do allow pets; however they must be kept under control and on a lead during your stay. If a dog does cause a nuisance or you arrive without pre booking a dog in, we reserve the right to ask that you take your dog to a local kennels. A maximum of two pets per tent is applicable, and there is a limit to how many dogs are on the farm at any one time. They must never be left in the tent without responsible supervision. There is a surcharge of £5 per pet per night. We regret that we do not accept dogs in Chysauster (our two storey tent) or Rosie (our gypsy caravan with bell tent). 7. Alteration costs If, after confirmation of the booking, you would like to make some alterations to the booking, Boswarthen Farm is not obliged to satisfy these requests. It is at the discretion of Boswarthen Farm whether, and to what extent, these alterations will be accepted. If, after confirmation of the booking of more than one tent, you want to reduce the number of booked tents, the cancellation provisions will be applicable. In principle, alterations cannot be permitted within 4 weeks prior to arrival and you will be liable for any costs incurred. 8. Cancellations If you decide to cancel more than 10 weeks before the start of your holiday, your deposit will be forfeited. If you cancel within 10 weeks of your holiday start date then the entire rental amount will be payable. If you decide to terminate your holiday early, no refunds will be given. Any cancellation by you, for whatever reason, must be made in writing or e-mail and addressed to Mrs. M Nicholls, Boswarthen Farm Cottage, Newbridge, Penzance, Cornwall TR20 8PA or email@example.com 9. Non-availability In the unlikely event that your booked holiday becomes unavailable following confirmation of the booking or changes are necessary to the booking for reasons outside our control, we undertake to notify you as soon as reasonably possible. If it is not possible to arrange alternative accommodation or if you do not wish to accept the alternative accommodation, the booking will be cancelled with a full refund of all monies paid, and we shall not have any further obligation or liability for non-availability, changes or cancellation as referred to in this condition. 10. Guest behaviour You and your family/party have the right to occupy the Property for the paid for, holiday period only (within the meaning of Schedule 1 Paragraph 9 of the Housing Act 1988). You, your family/party and other guests undertake to behave in a proper, appropriate and legal manner with due respect to the Us (The Owner), the accommodation (Property) and other guests and their property. If any guest behaves inappropriately or improperly (of which us- the Owner will be the final judge on their accommodation), or illegally, we (the Owner) reserve the right to ask the guest and their party (at their discretion) to leave the Property before the end of the holiday period. Any refund for so doing will be at the entire discretion of us (the Owner). In addition, we reserve the right to sue the guest for any loss, damage or injury caused to us (the Owner), the Property or to other guests and/or their property. If there is a breach of any of these conditions by the Guest or any of their party, we reserve the right to re-enter the Property and end the holiday and ask the Guest and their party to leave in addition to their other rights specified in these Booking Conditions. Ending the Holiday by us (the Owners) or the Guests does not affect that party’s other rights and remedies. 11. Governing law and jurisdiction Any dispute will be governed by the non-exclusive law and jurisdiction of the English Courts. 12. Authority to sign The person who signs the Booking Form certifies that: • he or she is authorised to agree the Booking Conditions on behalf of all persons included in the Booking Form, including those substituted or added at a later date; • the signatory is over eighteen years of age; • They agree to take responsibility for the party occupying the Property, and to notify Boswarthen Farm if they are not a member of the holiday party. 13 Liability Adrian and Madeliene Nicholls of Boswarthen Farm accepts • No liability for theft, loss or damage, of whatever nature, during or as a result of a stay at Boswarthen Farm. • Falling into defect or putting out of action of technical equipment and loss or closure of supplies at Boswarthen Farm. • the guest and those who accompany him or her, are jointly and severally responsible for all loss and/or damage which arises, for Boswarthen Farm and, or any third party as a direct or an indirect consequence of their stay, irrespective of whether this was caused through actions or refraining from actions by themselves or by third parties, who are at Boswarthen Farm their making, as well as of all damage which is caused by any animal and/or matter which they have under their responsibility. • If you leave your tent in an improper condition, additional (cleaning) costs can be charged. Nothing in these conditions excludes or limits the liability of the Owners: • for death or personal injury caused by Boswarthen Farm’s negligence. for any matter which it would be illegal for Boswarthen Farm to exclude or attempt to exclude their liability 14. Potential hazards The use of camp fires, fire pit, climbing trees and any other activity on the Boswarthen farm land is the responsibility of the Guest and is done so at their own risk. 15. Force majeure Force majeure on the side of Boswarthen Farm exists if the implementation of the agreement is entirely or partially, temporarily or permanently, prevented due to circumstances which are beyond the control of Boswarthen Farm, including threat of war, staff strikes, blockades, fire, floods and other disruptions or events. 16. Complaints Despite all the care of Boswarthen Farm it may occur that you have a genuine complaint. You must take up this complaint with the farmer immediately, in order to allow us to solve the matter as soon as possible. Should the complaint not be settled to your satisfaction, then you have the option, up to 10 days after departure from the farm to lodge the complaint in writing or by e-mail to the Mrs. M Nicholls, Boswarthen Farm. 17. Assumption of risks You will be staying on a working farm with live animals and potentially dangerous farm equipment amongst other hazards. Whilst we take great care to keep you safe, accidents can happen and we are not held responsible for such accidents (to the greatest extent permitted by law). It is your responsibility to supervise any children. If you notice that any equipment looks faulty and/or unsafe you must inform the farmer as soon as possible. We strongly recommend that you take out travel insurance against the risk of accidents and your stay being cut short. 18. Day visitors In principle, it is permitted to receive visitors during your stay at Boswarthen Farm. This must be arranged in advance and visitors will be required to leave full contact details. In principle we do not charge for visitors however we reserve the right to charge for any facilities that are used i.e. the showers. Visitors are limited to a maximum of 6. 19. Group bookings It is the right of Boswarthen Farm to refuse group bookings if we feel this may be of detriment to other guests staying on the farm. We may ask single sex groups (i.e. hen or stag parties) to take over all the tents. 20. General We are not bound by obvious errors in our printed material or online. Whether you wish to enjoy some family time, are a couple or just away with friends then life will certainly be slower here on the farm, where children can be children again - playing a game, collecting eggs or learning about life on a dairy farm and what it takes to provide milk for cheese.
Our spacious tents have wood burning stoves, a living space and separate bedrooms as well as their own cloakrooms. The lodge (two storey) has its own 'shower shed' whilst the others enjoy a shower block with really good Mira showers. Other cooking facilities include gas hobs and bbq/firepits
You can choose from a variety of luxury accommodation, so no matter how many in your party there will be something to suit you.

There is so much to see and do in the area, beaches, moor walks, the South West coastpath, St Michaels Mount, Minack Theatre and many more are just a short distance from us making us a really good base if you want to explore the area.
We also accept dogs although these family members are limited to two per tent and there is a maximum of four on site at anyone time. We even have a kennel if you want to go to a dog free beach for a day.

By Car: At Junction 31 of the M5 turn off onto the A30. Take the A30 almost to Penzance. At Chy-An-Mor roundabout take the 2nd exit onto Eastern Green past Sainsbury’s on the right. Approaching the roundabout (Tesco petrol station on right) take the 2nd exit onto A30 signposted Lands End. Continue at the next roundabout continue forward (2nd exit) still on the A30. At the next roundabout take the 4th exit onto Madron Road signposted Madron. Go through the village of Heamoor and go up Madron Hill passing Poltair Manor on the left. Continue up the hill entering Madron village, King William pub on the left. Through the village and out the other side , approx ½ mile you will approach an S bend, turn off to the right signposted Boswarthen, Celtic Chapel and Well. Drive under the trees ignore car park for the Wishing Well on the right, past a stone cross on your right and entering the farm lane. At the top of the third field located on your right is a gate way where you can drive through and park your vehicle. By train: The train will terminate in Penzance (you can’t go any further!) which is approx 2 ½ miles from Boswarthen (up hill if you are cycling) there is a taxi rank outside or just ring us and we will give you the number of some firms if you wish to pre book. Alternatively there is a car hire business there too.
